Apparently David C Purdue of Tennessee along with other iPhone 4 customers have taken legal action against Apple claiming the iPhone 4 is a faulty device and have asked from damages of $5,000,000 to cover their costs.
According to an article over on Techeye by Andrea Petrou, the court papers claim tha David c Purdue purchased an iPhone 4 about the 6th of July from an AT&T store in Franklin Tennessee for his personal use and paid approximately $200, and said he decided to buy an iPhone 4 after watching Steve jobs San Francisco video presentation.
However apparently the papers also say that Purdue saw the familiar story that “Apple had been rubbishing,” and Purdue began experiencing “extremely poor reception with his iPhone immediately after purchase.”
A quote from the legal document says…”Such poor reception has lead to, among other things, frequent dropped calls and inability to stream video. In addition, because of the position of the phone’s antenna, if Plaintiff holds his iPhone in his left hand the problem is compounded. Plaintiff attempted to return his iPhone, but an AT&T representative told him that he would be subject to a 15 percent restocking fee.”
Now we all know the iPhone antennagate issue and how Apple is moving forward by offering every iPhone 4 user a free bumper case, and apparently Purdue purchased a bumper hoping it would solve the issue.
However apparently Purdue isn’t satisfied and in the papers he claims “Apple did not act with due care when designing, manufacturing, marketing, and selling the defective iPhone 4,” and further claims Apple has “failed to use due care by failing to issue a voluntary recall, by failing to waive the restocking fee for returned iPhone 4’s, and by failing to refund monies for service contracts where the bargained-for service is not provided.”
