Well it looks like Apple has another lawsuit on their hands; these guys must be paying their brigade of lawyers a bucket load of bucks to have so many law suits on the go. This time round apparently Apple is being sued over the affects of iOS 4 on the iPhone 3G.
According to an article over on Gizmodo by Jesus Diaz and by way of Ars Technica, a class action lawsuit filed in the Superior Court for San Diego by Biana Wofford, accuses Apple of using the iOS 4 upgrade to “maliciously cripple the iPhone 3G, boosting sales of the iPhone 4.”
The lawsuit does hit on one very good point though and that is that Apple should make it easy to downgrade on iOS, and according to the complaint by Wofford…
“Even though Apple has actual knowledge of thousands of complaints from iPhone 3G/3GS consumers, Apple does not allow for those same users/consumers of third generation devices to download and re-install earlier and optimized iOS3.x operating system without resorting to ‘hacker’ tactics that will void Apple warranties and violate iPhone user agreements.”
Apparently Wofford believes that Apple intentionally did this to leave the iPhone 3G basically crippled and force iPhone 3G users to upgrade to the iPhone 4 and thus is looking for damages and restitution for herself and other class members.
So what are our readers views on this one, do you think Apple has knowingly made it difficult to downgrade on iOS so that iPhone 3G users are forced to move up to the iPhone 4?
