Samsung To Seek France and Italy iPhone 4S Ban
We all know just how the patent dispute between Apple and Samsung is going with Apple constantly hounding Samsung over their products and looking to get Samsung gear such as the Samsung Galaxy Tab 10.1 banned anywhere Apple can, and now Samsung is starting to fight back in the same way.
According to an article over on Slash Gear by way of Samsung Tomorrow, Samsung is attempting to give Apple a little of their own treatment and will apparently file separate preliminary injunction suits in Paris France and Milano Italy today the 5th of October.
Both preliminary injunctions are seeking the blocking of sales of the iPhone 4S in France and Italy and cite two patents that Samsung says Apple infringes upon, both to do with “Wideband Code Division Multiple Access (WCDMA) standards for 3G mobile handsets.”
Samsung claims “Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology. We believe it is now necessary to take legal action to protect our innovation.”
Apparently the tech in question is “essential to the reliable functioning of telecom networks and devices,” and Samsung is of the opinion that Apple’s violation is of the tech is “too severe and that the iPhone 4S should be barred from sales.”
Furthermore, it appears that Samsung isn’t prepared to just stop with France and Italy, as after review the company intend on filing preliminary injunctions in other countries as well.
Thus it would appear the worm has had enough of Apple’s bullying and has finally turned and hopes to hit Apple right where it hurts, the banning of their newly unveiled iOS smartphone. Whether Samsung will be successful in their venture is another matter, but if they are it will at least give Apple a taste of their own medicine.
